  • Our products, including those designed for use on vehicles, are intended for legal and safe use only. The Consumer's responsible for ensuring that the products comply with all applicable laws, regulations, and safety standards in their jurisdiction.

  • The Consumer acknowledges that Hero MFG LLC does not have control over how the products are used or installed after purchase. The Consumer is solely responsible for the products' proper installation, maintenance, and safe usage.

• Limitation of Liability

  • To the fullest extent permitted by law, Hero MFG LLC shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the purchase, installation, or use of our products, including but not limited to damages to property, personal injury, or death.

  • Hero MFG LLC shall not be liable for any damages resulting from the Consumer's failure to comply with applicable laws, regulations, and safety standards while using our products.

  • The Consumer agrees to assume all risks associated with using our products and acknowledges that Hero MFG LLC has adequately warned them about the potential dangers.

  • If Hero MFG LLC is found liable for damages, our total liability shall not exceed the product's purchase price.

• Product Warranty

  • Hero MFG LLC provides a limited product warranty, subject to specific terms and conditions outlined in our separate Warranty Policy.

  • Any consumer modifications or alterations made to the products will void the warranty.

  • Hero MFG LLC shall not be liable for any damages or injuries resulting from the Consumer's attempt to repair or modify the product without proper authorization.

• Indemnification

  • The Consumer agrees to defend, indemnify, and hold harmless Hero MFG LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses arising out of or related to the Consumer's use or misuse of our products, failure to comply with laws and safety standards, or violation of these Terms of Use.

• Governing Law and Jurisdiction

  • These Terms of Use shall be governed by and construed in accordance with the laws of Texas, without regard to its conflict of laws principles.

  • Any disputes arising out of or in connection with these Terms of Use or the use of our products shall be subject to the exclusive jurisdiction of the courts in Texas.

• Modifications to Terms

  • Hero MFG LLC reserves the right to modify or update these Terms of Use at any time without prior notice.

  • It is the Consumer's responsibility to review these Terms of Use periodically to stay informed of any changes.

By purchasing and using our products, the Consumer acknowledges that they have read, understood, and agreed to these Terms of Use, including the limitations of liability and the responsibility placed on the Consumer to ensure the legality and safety of product use.
